What the performance bond actually guarantees

A TABC performance bond is a compliance guarantee: it stands behind your promise to operate your wine and malt beverage retailer's permit in accordance with the Texas Alcoholic Beverage Code and the rules of the Commission. It is required of BG holders in Bexar, Dallas, Harris, and Tarrant counties who do not hold a Food and Beverage (FB) certificate.

It's a three-party arrangement: you (the principal), the surety carrier, and the Texas Alcoholic Beverage Commission (the obligee). If TABC forfeits the bond after a code or rule violation, the Commission can recover against it — and, if the surety pays, you repay the surety.

This is the third-bond $6,000 tier. The rule steps the amount up with each forfeiture: $2,000 for the first bond, $4,000 for the second, and $6,000 for the third — each one due before the permit can be reinstated. The Commission also accepts an assigned certificate of deposit or a letter of credit instead of all or part of the bond. We notify you 60 and 30 days before expiration so your filing stays continuous.

Tex. Alc. Bev. Code §11.61(b-1), §61.71(l) • 16 TAC §33.42The TABC performance bond is required by Texas Alcoholic Beverage Code §11.61(b-1) and §61.71(l) of BE and BG holders in counties with a population of 1.4 million or more — Bexar, Dallas, Harris, and Tarrant — without a Food and Beverage certificate, and is implemented by 16 Texas Administrative Code §33.42. Under §33.42(b) the first bond is $2,000; “In the event the first bond is forfeited to the commission, a licensee or permittee must file a second bond with the commission as prescribed under those provisions in the amount of $4,000 before a license or permit may be reinstated. In the event the second bond is forfeited to the commission, a licensee or permittee must file a third bond issued under those provisions in the amount of $6,000 before a license or permit may be reinstated.” This page is that third $6,000 bond.
