About this bond

What it is and who needs it.

What the financial-security bond actually guarantees

Texas licenses staff leasing services — professional employer organizations (PEOs) — through the Department of Licensing and Regulation under Labor Code Chapter 91. A PEO co-employs a client's workers and takes on payroll, payroll taxes, benefits, and workers' compensation. The state requires each licensee to demonstrate financial responsibility.

Labor Code §91.014 requires positive working capital in an amount set by the licensee's number of covered employees, and lets a PEO make up any shortfall with a bond, letter of credit, guaranty, or other security acceptable to the department. A surety bond is the common choice because it doesn't tie up the full amount in cash. This $75,000 bond is one of the tiers that applies.

It is not insurance for you. If the surety pays a claim — for unpaid wages, taxes, or other Chapter 91 obligations — you repay the surety. The bond protects the state and the PEO's client businesses; keep your obligations current and it stays a license formality.

Tex. Labor Code Ch. 91 (TDLR)Texas staff leasing services / professional employer organizations are licensed by the Department of Licensing and Regulation under Labor Code Chapter 91. Section 91.014 of that chapter requires positive working capital in an amount that steps up with the licensee's number of covered employees, and lets an applicant satisfy any deficiency with a guaranty, letter of credit, surety bond, or other security acceptable to the department. Confirm whether the $75,000 amount is the one TDLR requires of you before filing.

FAQ

Common questions.

Do I pay the $75,000?No. You pay $750 — the flat price our carrier's rate book sets for this bond. The $75,000 is the surety's maximum liability to the state and your client businesses; it's not a deposit, and nobody holds your money.
Who requires this bond? The Texas Department of Licensing and Regulation, as a way to meet the financial-security requirement for a staff leasing / PEO license under Labor Code Chapter 91.
Is $75,000 always the right amount? Not necessarily. The required security depends on your working capital and size — Labor Code §91.014 sets the working-capital figure by your number of covered employees, and a bond covers any deficiency against it. This page covers the $75,000 tier; if TDLR requires a different figure, send us your paperwork and we'll issue the right one.
Is there a credit check?A quick soft credit check may apply — it's never a hard inquiry and has no impact on your score. It informs approval, not price. The premium stays $750 either way: credit can affect whether we approve the bond, never what it costs.
When does it renew?Terms run 1, 2, or 3 years — your choice at purchase. You'll get renewal notices 60 and 30 days out, with autopay available, and the bond must stay active for your PEO license to stay valid.
Which A-rated carriers underwrite these bonds?Typically Arch Insurance Company (A.M. Best A+) or Nationwide Mutual Insurance Company (A.M. Best A). Which one writes your bond depends on the bond type and your state. The carrier's name and official signature are printed on the bond you receive.
How do I contact Light RFP about this bond?Email insurance@lightrfp.com. It reaches the bond team at Light RFP Risk Management Services LLC (NY DFS License # PC-1978982). Write to us about quotes, applications, bond forms or certificates. We will respond within 24 hours.
