What the performance bond actually guarantees

A TABC performance bond is a compliance guarantee: it stands behind your promise to operate your wine and malt beverage retailer's permit — the BG permit that older paperwork calls a wine and beer retailer's permit — in accordance with the Texas Alcoholic Beverage Code and the rules of the Commission. It is required of BG holders in Bexar, Dallas, Harris, and Tarrant counties who do not hold a Food and Beverage (FB) certificate, and it is filed with your original application.

It's a three-party arrangement: you (the principal), the surety carrier, and the Texas Alcoholic Beverage Commission (the obligee). If TABC forfeits the bond after a code or rule violation, the Commission can recover against it — and a larger replacement bond is then required before the permit is reinstated.

This is the first $2,000 tier. The amount escalates only after a forfeiture — to $4,000, then higher. Keep the bond active and the permit current, and most BG holders never see an escalation. We notify you 60 and 30 days before expiration so it stays continuous.

Code §11.61(b-1), §61.71(l) • 16 TAC §33.42The TABC performance bond is required by Texas Alcoholic Beverage Code §11.61(b-1) and §61.71(l) of BE and BG holders in counties with a population of 1.4 million or more — Bexar, Dallas, Harris, and Tarrant — who do not hold a Food and Beverage certificate, and is implemented by 16 Texas Administrative Code §33.42.
