About this bond

What it is and who needs it.

What the performance bond actually guarantees

A TABC performance bond is a compliance guarantee: it stands behind your promise to operate your wine and malt beverage retailer's permit — the BG permit that older paperwork calls a wine and beer retailer's permit — in accordance with the Texas Alcoholic Beverage Code and the rules of the Commission. It is required of BG holders in Bexar, Dallas, Harris, and Tarrant counties who do not hold a Food and Beverage (FB) certificate.

It's a three-party arrangement: you (the principal), the surety carrier, and the Texas Alcoholic Beverage Commission (the obligee). If TABC forfeits the bond after a code or rule violation, the Commission can recover against it — and, if the surety pays, you repay the surety.

This is the escalated $4,000 tier. The first performance bond is $2,000; after a forfeiture, a $4,000 bond is required before the permit can be reinstated — this page. A further forfeiture steps the amount up again. We notify you 60 and 30 days before expiration so your filing stays continuous.

Tex. Alc. Bev. Code §11.61(b-1), §61.71(l) • 16 TAC §33.42The TABC performance bond is required by Texas Alcoholic Beverage Code §11.61(b-1) and §61.71(l) of BE and BG holders in counties with a population of 1.4 million or more — Bexar, Dallas, Harris, and Tarrant — without a Food and Beverage certificate, and is implemented by 16 Texas Administrative Code §33.42. The rule sets the first bond at $2,000 and a $4,000 bond after the first forfeiture. Confirm your required amount on your TABC notice.

FAQ

Common questions.

How much is the $4,000 TABC performance bond? The premium is $100 flat — the price our carrier's rate book sets for this bond. The price you see is the checkout price.
Do I pay the $4,000?No. You pay $100. The $4,000 is the surety's maximum liability to TABC if the bond is forfeited — it's not a deposit, and nobody holds your money.
Why is the amount $4,000 and not $2,000?The first performance bond a BG holder files is $2,000. If TABC forfeits that bond after a violation, a $4,000 bond is required before the permit can be reinstated. This page is that escalated $4,000 tier.
Is there a credit check? The application collects no credit information, so most applicants approve instantly.
Who has to carry this bond?BE and BG retailers in Bexar, Dallas, Harris, and Tarrant counties who do not hold a Food and Beverage certificate. FB holders are generally exempt — check your TABC paperwork or send it to us.
Which A-rated carriers underwrite these bonds?Typically Arch Insurance Company (A.M. Best A+) or Nationwide Mutual Insurance Company (A.M. Best A). Which one writes your bond depends on the bond type and your state. The carrier's name and official signature are printed on the bond you receive.
How do I contact Light RFP about this bond?Email insurance@lightrfp.com. It reaches the bond team at Light RFP Risk Management Services LLC (NY DFS License # PC-1978982). Write to us about quotes, applications, bond forms or certificates. We will respond within 24 hours.
