What the settlement agent bond guarantees

Virginia's Consumer Real Estate Settlement Protection Act (CRESPA) governs who may handle residential real estate closings and conditions a settlement agent's registration on a $200,000 surety bond. The bond is a consumer-protection guarantee: it stands behind your proper handling of settlement and escrow funds.

It is a three-party arrangement: you (the principal), the surety carrier, and the Commonwealth (the obligee), with the parties to your closings as the protected beneficiaries. If a settlement agent mishandles closing funds, fails to record, or otherwise violates CRESPA, a harmed party can recover against the bond.

Settlement agents register with the State Corporation Commission's Bureau of Insurance, and the bond is one piece of the financial-responsibility package CRESPA requires (alongside errors-and-omissions and fidelity coverage). It is not insurance for you — if the surety pays a claim, you repay the surety.

Do I pay the $200,000?No. You pay $2,000 — the flat premium for this bond. The $200,000 is the surety's maximum liability to the Commonwealth and harmed parties; it is not a deposit, and nobody holds your money.
