What the bond actually guarantees

Virginia’s real estate settlement agents law (originally the Consumer Real Estate Settlement Protection Act, CRESPA) lets attorneys, title companies, real estate brokers, and financial institutions handle closings — provided they register and post security. For a law firm, Code of Virginia § 55.1-1004 requires a surety bond of not less than $200,000, on a form approved by the Virginia State Bar.

The bond is a consumer-protection guarantee: it stands behind the firm’s handling of escrow, closing, and settlement funds in real estate transactions. If the firm mishandles a buyer’s or lender’s money, the harmed party can recover against the bond.

It is not insurance for you — if the surety pays a claim, the firm repays the surety. Settlement agents who keep clean escrow records treat the $200,000 bond as a registration formality. (Attorneys also maintain separate fidelity / employee-dishonesty coverage for staff under the same law.)

Code of Virginia § 55.1-1004Code of Virginia § 55.1-1004 (Real Estate Settlement Agents; formerly CRESPA) conditions registration as a settlement agent on financial responsibility, including a surety bond of not less than $200,000 for an agent that is not a financial institution or title insurance company, on a form approved by the agent’s licensing authority — the Virginia State Bar for attorney settlement agents. The minimum was raised to $200,000 effective July 1, 2008.
