About this bond

What it is and who needs it.

What the refiner bond actually covers

Virginia taxes motor fuel under the Virginia Fuels Tax Act, administered by the DMV. A refiner — a person who owns, operates, or controls a refinery — is among the licensees the Act treats alongside suppliers, and is liable for the tax on the fuel it produces and removes.

Under Code of Virginia § 58.1-2211, a license applicant must file a bond or certificate of deposit conditioned on compliance with the Fuels Tax Act and payable to the Commonwealth. The Act has no separate refiner bond: § 58.1-2204(A)(1) says a refiner "shall be licensed as a supplier", and subsection A(1) of § 58.1-2211 fixes the bond at $2,000,000 for a supplier who is a position holder or receives fuel in a two-party exchange. Only a supplier that provides nothing but fuel alcohol posts three times its monthly tax instead.

The bond stands behind the fuels tax you collect or owe — if you fail to remit, the state can recover against it. Our carrier quotes 0.75% of the bond amount, which is $15,000 at $2,000,000, and an underwriter reviews a bond this size quickly.

Code of Virginia § 58.1-2211 (Fuels Tax Act)Under § 58.1-2211, applicants for fuels-tax licenses (including suppliers and refiners) must file a bond or certificate of deposit conditioned on compliance with the Virginia Fuels Tax Act, payable to the Commonwealth and in the form DMV requires. A refiner is licensed as a supplier (§ 58.1-2204(A)(1)), and subsection A(1) fixes the bond at $2,000,000 for a supplier who is a position holder or receives fuel in a two-party exchange.

The carrier notes that the final premium can vary with underwriting, and your exact price appears in the application before you pay.
Why does the amount vary so much? The Fuels Tax Act fixes $2,000,000 for the high-volume positions in the distribution chain — position-holder suppliers, which is how a refiner is licensed, along with terminal operators, bonded importers, and permissive suppliers.
