About this bond

What it is and who needs it.

What the bond actually guarantees

Utah's Department of Alcoholic Beverage Services (DABS) licenses retail alcohol operations under the Alcoholic Beverage Control Act (Title 32B), and conditions a resort liquor license on a surety bond. The bond is a compliance-and-tax guarantee: it stands behind your faithful compliance with Title 32B and the rules and directives of the Alcoholic Beverage Control Commission.

It's a three-party arrangement: you (the principal), the surety carrier standing behind you, and the State of Utah (the obligee). If a licensee violates the alcohol-control laws or fails to pay amounts owed, the state can recover against the bond up to the surety's limit.

It is not insurance for you — if the surety pays a claim, you repay the surety. The bond is one line item on a larger DABS packet that also includes application and license fees set by the state.

Utah Code Title 32B (Alcoholic Beverage Control Act)Utah's Alcoholic Beverage Control Act (Title 32B) authorizes DABS and the Alcoholic Beverage Control Commission to require a surety bond as a condition of a retail license. The resort license bond amount used here is $25,000, conditioned on the licensee's faithful compliance with Title 32B and Commission rules. Bond amounts and fees are set by statute and Commission rule and can change — confirm the current figure on your DABS application.

FAQ

Common questions.

Do I pay the $25,000?No. You pay $250 flat — the price is set by our carrier's rate book for this bond, not a percentage of the amount. The $25,000 is the surety's maximum liability to the state; it's not a deposit, and nobody holds your money.
Who requires this bond? The Utah Department of Alcoholic Beverage Services requires it as a condition of a resort liquor license, under the Alcoholic Beverage Control Act (Title 32B). The bond is filed as part of your DABS license packet.
What does the bond guarantee? That you faithfully comply with Title 32B and the rules and directives of the Alcoholic Beverage Control Commission. If you violate the alcohol-control laws or fail to pay amounts owed, the state can recover against the bond — and if the surety pays, you repay the surety.
Is there a credit check?A quick soft credit check may apply — never a hard inquiry, no impact on your score. It's the only extra step beyond the application, and it informs approval, not price. The price stays $250 either way: credit can affect whether we approve the bond, never what it costs.
Is the bond the only DABS cost?No — DABS also charges application and license fees set by statute, separate from the bond premium. We only handle the surety bond; confirm the current fee schedule with DABS.
Which A-rated carriers underwrite these bonds?Typically Arch Insurance Company (A.M. Best A+) or Nationwide Mutual Insurance Company (A.M. Best A). Which one writes your bond depends on the bond type and your state. The carrier's name and official signature are printed on the bond you receive.
