What the P-5 performance bond actually covers

Every person who performs oil and gas operations within the Texas Railroad Commission's jurisdiction must file an annual P-5 Organization Report and post financial assurance under Natural Resources Code §§91.103 and 91.104. A performance bond is one accepted form of that assurance (alongside a letter of credit or cash deposit).

The bond guarantees that you properly maintain, plug, and abandon your wells and comply with Commission rules — it protects the State of Texas, not the operator. A blanket bond is sized by well count ($25,000 for 1–10 wells, $50,000 for 11–99, $250,000 for 100 or more); an individual bond is generally calculated by aggregate well depth at $2 per foot.

Operators may alternatively post the amount of the cost calculation to plug their inactive wells (capped at $2 million). Natural Resources Code §91.104Texas Natural Resources Code §§91.103–91.104 require operators within the Railroad Commission's jurisdiction to file financial assurance with their P-5 Organization Report. The amounts are set one section further on: §91.1042 fixes the blanket performance bond at $25,000 (1–10 wells), $50,000 (11–99 wells), or $250,000 (100 or more wells), and §91.1041 sets an individual bond at $2 per foot of aggregate well depth. Separately, an operator seeking a plugging extension for inactive wells may post the Commission's cost calculation for plugging them, capped at $2 million — that is in addition to the P-5 financial assurance, not instead of it.
