What the facility closure bond actually covers

The Texas Railroad Commission regulates oil-and-gas waste facilities under its environmental rules. Under 16 Texas Administrative Code §3.78 (Statewide Rule 78), a permittee operating a commercial or permitted waste facility must maintain financial security until the facility is fully closed in accordance with the permit.

The required amount equals the maximum cost necessary to close the facility — the Commission sets it on the permit and reserves the right to revise it as conditions change. The bond ensures that if the operator does not close the facility properly, the state has the funds to do it. It protects the State of Texas, not the operator.
