What the disposal bond actually covers

An operator that disposes of saltwater or other oil-and-gas waste by injection into a non-productive formation must comply with Water Code Chapter 27 and Title 3 of the Natural Resources Code, and obtain a permit from the Railroad Commission of Texas. The Commission's disposal-well rule is 16 TAC § 3.9.

Rule 3.9 itself sets no bond. Under Natural Resources Code § 91.109, a person applying for or acting under a Commission permit to store, handle, treat, reclaim, or dispose of oil-and-gas waste may be required to maintain a performance bond or other form of financial security, conditioned that the permittee will operate and close the site in accordance with state law, Commission rules, and the permit.

It is not insurance for you — if the surety pays a claim, you repay the surety. The Commission sets the amount based on your operation (operators commonly also post an organization-wide bond or letter of credit).
