Maryland licenses motor fuel dealers, special fuel sellers, and special fuel users through the Comptroller of Maryland, which can require a bond as security for the motor fuel tax. A dealer who is also a licensed special fuel seller or user posts only one security covering all of those roles.

The Comptroller sets the amount, in even $1,000 increments, based on your fuel tax exposure. The bond guarantees that you file your fuel tax returns and pay the tax when it becomes due — it stands behind the tax you collect or owe on the fuel you handle.

Some users are exempt at low volumes — for example, a biodiesel user generally isn’t bonded unless they use more than 4,000 gallons a year, while diesel sellers are bonded. If you fail to remit, the Comptroller can recover against the bond, and if the surety pays, you repay the surety.
