What the bond actually guarantees

A professional solicitor is anyone who, for compensation, solicits contributions for a charitable organization. Hawaii requires each professional solicitor to file a $25,000 bond with and approved by the Attorney General under HRS 467B-12 before registering with the Tax & Charities Division.

It's a three-party arrangement: you (the principal), the surety carrier, and the State (the obligee). The bond inures to the benefit of the State and is conditioned that the solicitor — its officers, employees, agents, and independent contractors — will not violate HRS chapter 467B.

The bond remains in effect for one year. If the solicitor violates the chapter and the State or the public is harmed, a claim can be made against the bond — and if the surety pays, you repay the surety. We track the term and send renewal notices ahead of expiration.

HRS 467B-12 (Filing requirements for professional solicitors)Hawaii Revised Statutes 467B-12 requires each professional solicitor to file with and have approved by the Attorney General a bond in the penal sum of $25,000, with good and sufficient surety, which remains in effect for one year. The bond inures to the benefit of the State, conditioned that the solicitor and its officers, directors, employees, agents, and independent contractors will not violate chapter 467B.
