About this bond

What it is and who needs it.

What the title agent bond actually covers

Texas licenses title insurance agents and direct operations through the Department of Insurance under Insurance Code Chapter 2651. Each agent and direct operation must make, file, and pay for a surety bond payable to the Department, filed on form FINT122.

The bond is conditioned on paying any pecuniary loss sustained by a participant in an insured real-property transaction through an act of fraud, dishonesty, theft, embezzlement, or wilful misapplication by the agent or direct operation — and on covering Department administrative expense in a receivership.

The amount is set by statute at the greater of $10,000 or 10% of the gross premium written by the agent or direct operation in its latest statistical report to the Department, not to exceed $100,000. Under § 2651.102, TDI also accepts cash, an irrevocable letter of credit, or approved securities in lieu of a bond; the application for the surety bond collects no credit information, and pricing is variable by bond amount, from $100.

Tex. Ins. Code § 2651.101 (form FINT122)Texas Insurance Code § 2651.101 requires each licensed title insurance agent and direct operation to file a surety bond payable to the Department of Insurance (form FINT122), in an amount equal to the greater of $10,000 or 10% of the gross premium written in the latest statistical report to the Department, not to exceed $100,000. The bond covers pecuniary loss from fraud, dishonesty, theft, embezzlement, or wilful misapplication, and Department receivership expense. Under § 2651.102, TDI also accepts cash, an irrevocable letter of credit, or approved securities in lieu of a bond.

FAQ

Common questions.

How much is the Texas title insurance agent bond? The premium is 1% of the bond amount, with a $100 minimum. The amount itself is set by statute at the greater of $10,000 or 10% of your gross premium written in your latest TDI statistical report, capped at $100,000. Enter that figure at the application to see your exact price.
How do I figure my bond amount?Take the greater of $10,000 or 10% of the gross premium written shown in your latest statistical report to the Department of Insurance, then cap it at $100,000. If you are new and have not filed a report, TDI will tell you the starting amount — send it to us and we will issue it.
Is there a credit check? The application collects no credit information, and most applications approve instantly.
Can I use a deposit or letter of credit instead?Yes — Insurance Code § 2651.102 lets you meet the requirement by depositing cash, an irrevocable letter of credit, or department-approved securities instead of a bond. A surety bond is usually the cheapest, since you pay a variable premium from $100 rather than tying up the full amount.
Where do I file it?With the Texas Department of Insurance, on form FINT122, as proof of bond for your title agent or direct operation license. We issue the executed bond ready to file.
Which A-rated carriers underwrite these bonds?Typically Arch Insurance Company (A.M. Best A+) or Nationwide Mutual Insurance Company (A.M. Best A). Which one writes your bond depends on the bond type and your state. The carrier's name and official signature are printed on the bond you receive.
How do I contact Light RFP about this bond?Email insurance@lightrfp.com. It reaches the bond team at Light RFP Risk Management Services LLC (NY DFS License # PC-1978982). Write to us about quotes, applications, bond forms or certificates. We will respond within 24 hours.
