About this bond

What it is and who needs it.

What the blanket performance bond covers

Under ORS 374.305, no one may build, construct, or place anything in the right of way of an Oregon state highway without ODOT's written permission — a highway permit. ODOT issues single-use permits for one-off work and blanket permits for contractors and utilities that work in the right of way regularly.

ODOT can condition a permit on a performance bond. A blanket bond covers all of your permitted work at once — grading, leveling, drainage, paving, pipe and utility installation — so you don't post a separate bond for every job. The bond guarantees you complete the work to ODOT's specifications and restore the right of way.

If you don't perform — incomplete work, damage to the road, or failure to restore the site — ODOT can recover against the bond to fix it. It is not insurance for you: if the surety pays, you repay the surety. Pricing on the amount ODOT set is variable, from $100, and the application collects no credit information.

ORS 374.305 (ORS ch. 184 & 374)ORS 374.305 requires written permission from the Oregon Department of Transportation before building or placing anything in a state highway right of way, and authorizes ODOT to remove or repair unpermitted work at the contractor's expense. ODOT may condition a right-of-way permit on a performance bond; a blanket bond covers all of a contractor's or utility's permitted work. Confirm your required amount on the ODOT permit.

FAQ

Common questions.

How much is the Oregon highway permit blanket bond?Pricing is 1% of your bond amount, with a $100 minimum. The amount itself is set by ODOT based on the scope of your right-of-way work. Enter the figure on your permit and your exact price appears.
What's the difference between a single-use and blanket bond?A single-use permit and bond cover one specific job in the right of way. A blanket permit and bond cover all of your permitted highway work at once — better for contractors and utilities that work in ODOT right of way regularly.
What does the bond guarantee? That you complete your permitted work to ODOT specifications and restore the right of way. If you fail to and ODOT has to fix it, the agency can recover against the bond — and if the surety pays, you repay the surety.
Is there a credit check? The application collects no credit information for most bond amounts. Larger bond amounts may get a quick soft-pull review, which never affects your credit score.
Where do I file it?With the Oregon Department of Transportation, as part of your blanket right-of-way / highway permit. We issue the executed bond ready to submit.
Which A-rated carriers underwrite these bonds?Typically Arch Insurance Company (A.M. Best A+) or Nationwide Mutual Insurance Company (A.M. Best A). Which one writes your bond depends on the bond type and your state. The carrier's name and official signature are printed on the bond you receive.
How do I contact Light RFP about this bond?Email insurance@lightrfp.com. It reaches the bond team at Light RFP Risk Management Services LLC (NY DFS License # PC-1978982). Write to us about quotes, applications, bond forms or certificates. We will respond within 24 hours.
