What the damage bond actually covers
New Mexico's Commissioner of Public Lands grants easements and rights-of-way across state trust land for roads, pipelines, utility and power lines, and similar uses under 19-7-57 NMSA 1978. The grantee must compensate the state — or its lessee, patentee, or purchase-contract holder — for the reasonable value of any measurable damage done to improvements or other property lawfully on the land burdened by the right-of-way.
To secure that obligation, the applicant files a bond with the Commissioner before the easement or right-of-way issues, in an amount the Commissioner determines is sufficient to cover the damages. The rules also allow a $25,000 blanket bond — or another amount the Commissioner sets — to cover more than one easement or right-of-way the grantee holds with the State Land Office.
