What the escrow company bond guarantees

New Mexico regulates escrow companies under the Escrow Company Act, NMSA § 58-22-1 et seq. A company that holds documents, money, or property in escrow for New Mexico transactions is licensed by the Financial Institutions Division of the Regulation and Licensing Department, and NMSA § 58-22-10 requires it to obtain a surety bond in the minimum amount of $100,000.

The bond runs to the people of the State of New Mexico. It is a three-party arrangement: you (the principal), the surety carrier, and the state as obligee, with the parties to your escrows as the protected public. If an escrow company mishandles escrowed funds or violates the Act, a harmed party can recover against the bond.

It is not insurance for you — if the surety pays a claim, you repay the surety. The bond must be in a form acceptable to the director, stays on file in the director's office, and must remain active for the life of your license — we track the term and send renewal notices 60 and 30 days out.
