New Jersey's State Highway Access Management Act (N.J.S.A. 27:7-89 et seq.) governs how driveways and streets connect to State highways. NJDOT issues an access permit for the construction and maintenance of that connection, and can require a surety bond as a financial guarantee that the work is done — and kept up — to the Department's standards.
This is the maintenance side of that guarantee: it backs the permit holder's obligation to maintain the completed access work so it continues to function safely. The bond is for the benefit of NJDOT and the public; if the access falls into disrepair or the work isn't completed, the Department can recover against the bond to set it right.
