About this bond

What it is and who needs it.

What the alcoholic beverage tax bond covers

Louisiana taxes alcoholic beverages under the Alcoholic Beverage Tax Law (La. R.S. 26:341 et seq.), collected by the Department of Revenue. A manufacturer or wholesale dealer that owes this excise tax must post a financial guarantee so the state is protected on the tax due before it is remitted.

Under La. R.S. 26:348 and 26:350, the guarantee — a surety bond, certificate of deposit, or letter of credit — must be at least $10,000 for each type of permit held. The bond (Form ABT-SURETY) obligates you to perform the conditions of the tax law and pay all taxes, penalties, and costs.

The bond stands behind the tax you collect or owe — if you fail to remit, the state can recover against it. It is a continuing bond, terminable on thirty days' notice. We issue the amount the Department set, with pricing from $100 and no credit section for most filers.

La. R.S. 26:348 and 26:350 (Form ABT-SURETY)Under the Louisiana Alcoholic Beverage Tax Law, La. R.S. 26:348 and 26:350 require a manufacturer or wholesale dealer to furnish the Department of Revenue a bond (or certificate of deposit or letter of credit) of at least $10,000 for each type of permit held, conditioned on payment of the tax. The Department may require a larger amount based on your tax liability — confirm the figure on your notice or registration, and we'll issue the matching bond.

FAQ

Common questions.

How much is the Louisiana alcoholic beverage tax bond? The premium is 1% of your bond amount, $100 minimum. The bond amount itself is set by the Department of Revenue — at least $10,000 for each type of permit held, and potentially more based on your tax liability. Enter your figure and your exact price appears in the on-page calculator.
Why is the minimum $10,000?La. R.S. 26:348 and 26:350 set a $10,000 floor for the guarantee for each type of permit held. The Department of Revenue can require a higher amount, so enter the figure on your notice if it exceeds the minimum.
Is there a credit check? Most bond amounts approve instantly with no credit section. Larger bond amounts may get a quick soft-pull review, which never affects your credit score.
Which form do I file?Form ABT-SURETY, the Louisiana alcoholic beverage tax surety bond, filed with the Department of Revenue. We issue the executed bond ready to submit with your registration.
Is this the same as my ATC permit? No. The Office of Alcohol and Tobacco Control issues your alcohol permit; this tax bond is a separate Department of Revenue requirement that guarantees the excise tax. You generally need both — the bond is the part we issue.
