What the bond actually guarantees

Alabama requires annual inspection of certain vessels and residence boats for proper marine sanitation devices (MSDs). These inspections are carried out by special agents designated by the Department of Conservation and Natural Resources (DCNR) Marine Police Division, and a special agent must post a $10,000 indemnity bond before being appointed.

The bond protects the DCNR: it guarantees that you remit the inspection fees you collect and abide by the policies and procedures the Marine Police Division sets for special agents. If you fail to remit fees or otherwise breach your special-agent contract, the DCNR can recover against the bond.

It is not insurance for you — if the surety pays a claim, you repay the surety. The special-agent program was authorized effective October 1, 2008, implementing the inspection requirement in Code of Ala. § 33-6A-6.
