Valley Water requires experienced, and qualified Cultural Resources, Paleontological Resources, and Tribal Cultural Resources firms to provide a full range of on-call cultural, paleontological, and tribal cultural resources assessment, investigation, compliance, monitoring, and consultation-support services for Valley Water’s Stream Maintenance Program projects.
A. The Santa Clara Valley Water District (Valley Water) implements a number of capital and operational projects and programs to meet its mission and goals in water supply, flood protection and watershed stewardship. The on-call services provided pursuant to this Agreement will augment the services of Valley Water staff and provide additional On-Call Cultural Resource Assessment and Tribal Resources services as needed.
B. Provide Valley Water with qualified on-call capacity to complete cultural resources, paleontological resources, and tribal cultural resources assignments in accordance with each authorized Task Order, the current Stream Maintenance Program (SMP) permits and Best Management Practices (BMPs), and applicable environmental compliance requirements.
C. Complete desktop reviews, field investigations, consultation support, monitoring, and reporting within Task Order schedules so that SMP maintenance activities can proceed without avoidable cultural resources compliance delays.
D. Provide complete, technically defensible work products that meet the objective acceptance criteria in this Exhibit A, incorporate Valley Water consolidated comments, and are suitable for submittal to reviewing agencies when requested.
E. Support Valley Water-led tribal consultation and coordination while preserving government-to-government relationships, respecting confidentiality, and clearly identifying decisions or commitments that must be made by Valley Water.
F. Immediately communicate discoveries and other critical issues, establish or recommend appropriate protective measures, and provide documented recommendations before affected work resumes.
G. All Services required pursuant to this Agreement will be provided only on an as-needed/as-requested basis by the issuance of an authorized Task Order by the Valley Water to the Consultant. A project scope will be developed for each task order, including deliverables for a total not-to-exceed amount. No work will be performed without a task order. The Consultant will perform services on a Task Order Basis as authorized by the VW PM, as set forth in the Standard On-Call Consultant Agreement, Section Twelve, Miscellaneous Provisions, subsection 13. Minimum Qualifications:
The following qualifications are the minimum required qualifications that a Proposer must meet for a proposal to be considered responsive:
· The Proposer or Proposer’s employees shall have 5 years of experience providing cultural resource assessment and tribal resources services for projects of similar scope and complexity to the services described in Section 5, Preliminary Scope of Services.
· The Proposer or Proposer’s employees shall have experience in cultural and paleontological resource identification and evaluation.
· The Proposer or Proposer’s employees shall have experience in coordinating activities with California Native American tribes and designated contacts, as required.
· The Proposer or Proposer’s employees shall have experience with inadvertent discoveries of resources and construction “stopped work” situations.
· The Proposer’s key staff shall possess the certifications, licenses, qualifications, or affiliations required to perform the cultural and paleontological services.
· The Proposer shall possess knowledge of applicable regulations and codes, including the National Historic Preservation Act and Section 106 requirements, and be familiar with local conditions in Santa Clara County.
