- 1. Consultant shall be responsible for the completion of environmental and hazmat testing, inspections, related consultation, and abatement, decontamination, and remediation project management. The required services will address potential or existing hazards such as asbestos, mold, lead-based paint, chemicals, gases, explosives, and similar substances that pose risks to health, safety, or the environment during production, storage, or transportation. The services may include the following DOT hazard classes: 1 - Explosives 2 - Gases 3 - Flammable and Combustible Liquids 4 - Flammable Solids 5 - Oxidizers & Organic Peroxides 6 - Toxic & Infectious Substances 7 - Radioactive Materials General Requirements • Consultant must be familiar with all laws relating to disposal of the materials as stated herein and is familiar with and will comply with all guidelines, requirements, laws, regulations, and any other federal, state, or local agencies or authorities. • Consultant understands that it will be solely responsible for any liability, fees, fines, claims, etc., which may arise from its handling of materials not covered by this scope of work. • When collecting sampled materials, Consultant shall ensure that all loads are properly secured and transported without threat of harm to the general public, private property, and public infrastructure. • Consultant shall ensure that service is performed in compliance with industry standards and all federal, state, and local laws, ordinances, and regulations (including TOSHA and OSHA rules and regulations). • Consultant shall comply with all federal, state, and local safety regulations and take any additional steps necessary to ensure the safety of employees and the 8

Introduction The Metropolitan Government of Nashville and Davidson County
("Metro") is soliciting proposals from qualified, experienced
technical services consultants responsible for and performing a

2.1 Section 1. RFQ Solicitation A&E (Selection) Method
1.
Pursuant to Metropolitan Code of Laws (M.C.L.) Section 4.08.080, this solicitation
document serves as the written determination of the Purchasing Agent, that this is a
solicitation for qualified A&E firms. Contracts for professional services, including
architectural and engineering services, are awarded on the basis of recognized
competence and integrity. The Purchasing Agent has secured the approval of a Review
Board to conduct evaluations. For the proposal process, the solicitation flexibility and its
limitations are governed by the Metro Code and related Procurement Regulations.
The proposal selection method permits discussions with offerors who submit proposals
determined to be reasonably susceptible of being selected for award. Modifications in
proposal content, comparative judgmental evaluations of the proposals, corrections, and
scope adjustments, may occur at the request of the Purchasing Agent or their designee.
There may be one or more amendments to this solicitation. Solicitation amendments are
included as updates to the original solicitation. It is the offeror's responsibility to remain
informed on all solicitation amendments and submit the solicitation response incorporating
all amendments.
Offers to Metro online solicitations are required to be submitted within the iSupplier online
environment unless otherwise stated. Hard copy offers will not be considered except as
required by law.

Any response to this solicitation is a formal waiver of any claims of confidentiality
regardless of what may be stated, printed, or implied in the submission and/or
attachments submitted. All information is made a Public Record after an award is made.
The only official position of Metro is found within this solicitation including answers
provided in response to questions raised. The online discussion tool within iSupplier is
the appropriate tool for all questions or communications concerning this solicitation.
Metro reserves the right to issue additional rounds as it deems necessary for the purposes
of evaluation. Additional rounds may include, but not be limited to, Offeror interviews.
Metro reserves the right to make multiple awards for a contract if it is deemed in the
best interest of Metro.
2.2 Section 2. Waiver Process
1. Pursuant to Metropolitan Code of Laws (M.C.L.) Section 4.48.115 (Conflicts with Previous Metro Projects),
Non-Metro employees who provide services to the metropolitan government regarding the feasibility, cost,
design, implementation, or legislative adoption of a particular matter are prohibited from subsequent
participation in the procurement process or resultant contract(s) related to that particular matter.
Any offeror who may meet the standard of MCL 4.48.115 must disclose this potential conflict to the buyer
prior to the solicitation's deadline for questions. This disclosure must include reference to the offeror's prior
work on the particular matter, including the specific project and prospective offerors' participation, and the
timeframe services were rendered. If the offeror is requesting a waiver from MCL 4.48.115 this must be
explicitly stated in the disclosure.
Requests for a waiver will be reviewed by the Procurement Standards Board with final decisions published
in the news items section of purchasing.nashville.gov.

1. The objective of this solicitation is to enter into an indefinite delivery/indefinite quantity (IDIQ) contract. Metro
does not guarantee minimum or maximum purchase amounts for the requested goods and/or services.
Purchases shall be made on an as-needed basis by Metro via Purchase Order. No purchase is guaranteed,
and no work shall be performed until receipt of Metro-issued Purchase Order.

• Consultant shall immediately discontinue any practice determined by Metro to
be hazardous or otherwise imprudent.
Performance
• Consultant shall complete all work pursuant to this contract in accordance and
compliance with American Society for Testing and Materials (ASTM)
environmental assessment and risk management standards.
• Consultant shall be responsible for the assessment of the property to determine
the presence of asbestos and other regulated hazardous materials.
• Consultant shall be responsible for the timely delivery of any or all of the
following environmental testing, inspecting, and consulting services as may be
requested by Metro including but not limited to :
•
• Site survey;
• Assessing environmental and HazMat conditions of existing facilities, systems, and
materials.
• Evaluating conditions for removal/abandonment, which may include the following:
•
• Identification of offending material type and classification.
• Conduct site observations of property and surrounding properties to report
existing site conditions, activities, and use.
• Regulatory agency database reviews to identify any pertinent information.
• On-site (and from any other available source) records review to determine
the nature and extent of any prior remediation operations (including
methods and disposal).
• Research titles, plats, and deeds to document relevant legal descriptions.
• Historic records review to ascertain past property and surrounding
properties use.
• Identification of prior uses or activities at or near sites that could have
involved HazMat manufacture, generation, use, storage, or disposal,
which potentially impacted or created environmental issues.
• Identification of natural/environmental conditions that may be adversely
impacted by proposed use; and
• Recommend whether an assessment of geologic and hydrogeological
conditions would be prudent.
• Recommending appropriate types, levels, and quantities of testing and
monitoring.
• Testing, inspection, and related analysis.
• Developing appropriate abatement, decontamination, or remediation plan
and project scope of work; and
• Documenting incremental and comprehensive reports of details, data,
findings, and recommendations resulting from requested service. `
• Consultant shall provide project management for abatement, decontamination,
or remediation plan execution as requested by Metro. Such project
management service may be included, but is not limited to,
•
• Defining a detailed remediation contractor scope of work;
• Scheduling, coordinating, and facilitating preconstruction meeting(s) with affected
stakeholders and contractors.

• Scheduling, coordinating, and facilitating public meetings pertaining to the project.
• Monitoring remediation operations.
• Scheduling, coordinating, and facilitating project progress meetings as appropriate.
• Maintaining comprehensive project records.
• Reviewing project submittals, shop drawings, pay requests, cost estimates, reports,
close-out documents, and any other project documents for compliance with relevant
requirements and accuracy and documenting such review and approval
recommendation for each.
• Testing, inspecting, and related analysis for purposes of assessing remediation effort;
and
• Certifying remediation project completion in compliance with requirements, industry
best practices, and ASTM standards.
Regulated Material Survey
• Consultant shall conduct a Regulated Materials Survey (RMS). The RMS shall
include an assessment of asbestos-containing materials, lead-containing
paints, equipment potentially containing refrigerants, potentially polychlorinated
biphenyl (PCB)-containing hydraulic fluids, transformers, and fluorescent light
ballasts, and potentially mercury-containing lamps, switches and thermostats.
The survey shall also include an inventory of chemicals and petroleum products
remaining on the site. In addition to any hazardous class of DOT material
identified by the survey to be removed or remain on site for future disposal or
special handling.
• Consultant shall notify Metro of the planned schedule for the field work at least
two (2) working days prior to commencement. The Contractor shall complete
the RMS survey and submit the report to Metro within thirty (30) calendar days
from the notice to proceed on a project identified by the department utilizing the
contract.
Asbestos Survey
• A 'walk-through' survey of accessible areas in each structure, including garages
and all accessory structures, shall be conducted to identify suspect asbestos-
containing materials (ACM). The asbestos survey shall be performed by
AHERA (Asbestos Hazard Emergency Response Act) certified Building
Inspector(s) licensed in the State of Tennessee.
• The Building Inspector(s) shall collect samples of each suspect ACM per
homogeneous area to satisfy National Emission Standards for Hazardous Air
Pollutants (NESHAP) requirements for demolition and renovation as found in
40 CFR Part 61 Subpart M. It is anticipated that destructive sampling, such as
cutting the wall to access the insulation in the wall cavity, or removal of a small
section of carpet to access concealed flooring, will be required to determine if
hidden suspect materials are present. The roof will be sampled as part of the
survey.
