NOTICE OF INTENT TO SOLE SOURCE Maintenance and Support of Luminex LX200 and INTELLIFLEX In accordance with Federal Acquisition Regulation (FAR) Revolutionary FAR Overhaul (RFO) 12.102(a), the US Environmental Protection Agency intends to award a sole source, firm fixed priced purchase order under the Simplified Acquisition Threshold (SAT). THIS IS NOT A SOLICITATION OR REQUEST FOR QUOTE (RFQ) DO NOT SUBMIT A QUOTE The U.S. Environmental Protection Agency (EPA), Office of the Administrator (AO), Office of Applied Sciences and Environmental Solutions (OASES), Applied Science and Environmental Methods Division (ASEMD) has a requirement for the continued maintenance and support of two brand name laboratory instruments from the Luminex Corporation. JUSTIFICATION FOR SOLE SOURCE PROCUREMENT: Luminex Corporation, located at 12212 Technology Blvd Austin, TX 78727-6115, is the only qualified entity to provide the services identified in this notice. There are no substitutes available. The EPA purchased two instruments to conduct research efforts: Luminex LX200 and Luminex INTELLIFLEX. Continued maintenance and servicing of Luminex instrumentation by Luminex technicians and engineers is needed for continuity of ongoing studies and to prohibit voiding of the instruments’ warranties by the manufacturer. The EPA requires the following: • Unlimited visits for emergency repair • All costs associated with emergency repair (includes travel, parts and labor) • One preventative maintenance visit per year • Priority scheduling for requests for service • Product Updates and Modifications • Telephonic and online support 24 x 7 • On-Site 2nd business day response time for Repair Services It is critical that the Luminex instruments be in proper functioning order to conduct human exposure and infection research. Therefore, careful maintenance of the Luminex instruments is required for safe operation and execution of EPA's research, and this maintenance must be performed by trained specialists. Because the LX200 and INTELLIFLEX systems are manufactured by Luminex Corp., this company is uniquely qualified to service and maintain EPA’s instruments. Previously, EPA researchers attempted to use other vendors to service the Luminex equipment, but doing so invalidates Luminex’s warranty. In addition, previous experience demonstrated that other vendors must send repair/replace requests back to Luminex to have Luminex’s field engineer fix the issues. This further demonstrates that only Luminex can properly maintain their equipment without voiding warranties. Based on this and current market research, it has been determined that no other contractor is capable of providing the required maintenance and support to the Luminex analyzers; specifically, the LX200 and INTELLIFLEX. THIS IS NOT A SOLICITATION OR REQUEST FOR QUOTE (RFQ) DO NOT SUMMIT A QUOTE The North American Industrial Classification System (NAICS) code for this effort is 541990 – All Other Professional, Scientific, and Technical Services and the business size standard is $19.5 million. Any interested party that believes it can meet this requirement described herein may identify themselves and shall provide evidence of their capability with product literature to fulfill this requirement being requested by 17:00PM ED on August 21, 2026. All responses shall identify their active UEI number as registered in System of Award Management (SAM). Responses shall be submitted in writing to back.kaela@epa.gov no later than the time and date noted above. Telephone responses and requests will not be accepted. This announcement constitutes the only synopsis for this requirement and is issued for notification purposes only. A determination by the Government not to compete this requirement based on responses to this notice is solely within the discretion of the Government.
